Please read these terms carefully before using BrightPlanning.

Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and BrightPlanning ("Company," "we," "our," or "us") concerning your access to and use of the BrightPlanning platform.
By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.
1. Account Terms
- You must be 18 years or older to use this Service.
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the security of your account and password.
- You are responsible for all activities that occur under your account.
- One person or legal entity may not maintain more than one free account.
2. Acceptable Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to any portion of the Service
- Interfere with or disrupt the Service or servers
- Upload viruses or malicious code
- Resell or redistribute the Service without explicit permission
3. Payment Terms
Billing Cycles: Subscription fees are billed monthly or annually in advance, depending on your chosen plan.
Payment Methods: We accept credit cards, debit cards, and bank transfers for payment.
Refunds: Refunds are provided on a case-by-case basis for annual subscriptions within 30 days of purchase. Monthly subscriptions are non-refundable.
Price Changes: We reserve the right to modify pricing with 30 days' notice. Existing customers will be grandfathered at their current rate for the remainder of their billing cycle.
Late Payments: Access may be suspended for accounts with overdue payments. A €25 late fee may apply to payments more than 15 days overdue.
4. Data Ownership & Intellectual Property
Your Data
You retain all rights to your production data, order information, and content uploaded to BrightPlanning. We claim no intellectual property rights over the material you provide.
Our Platform
The Service, including its original content, features, and functionality, is owned by BrightPlanning and is protected by international copyright, trademark, and other intellectual property laws.
License Grant
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes in accordance with these Terms.
5. Service Availability
Uptime: We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service.
Maintenance: We may perform scheduled maintenance with advance notice. Emergency maintenance may occur without notice.
Changes to Service: We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice.
Support: Email support is available to all paying customers. Response times vary by plan tier (see pricing page for details).
6. Termination
By You: You may cancel your account at any time through your account settings or by contacting support.
By Us: We may terminate or suspend your account immediately, without prior notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.
Effect of Termination: Upon termination, your right to use the Service will immediately cease. You may request an export of your data within 30 days of termination.
Data Retention: We will retain your data for 30 days after account termination, after which it will be permanently deleted.
7. Limitation of Liability
To the maximum extent permitted by applicable law, BrightPlanning shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or data
- Business interruption
- Loss of anticipated savings
- Loss of business opportunity, goodwill, or reputation
Our total liability to you for all claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Governing Law & Disputes
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
Jurisdiction: Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Limburg, Netherlands.
Dispute Resolution: We encourage you to contact us first to resolve any disputes informally before pursuing formal legal action.
